National Programming Service's Right to Sell Distant Network Programming
Upheld by Federal Court of Appeals
July 7,2008 - INDIANAPOLIS - In a unanimous opinion issued today, the Eleventh Circuit Court of Appeals upheld Indianapolis-based National Programming Service (NPS), LLC's right to lease satellite equipment from EchoStar Communications Corporation (EchoStar) and retransmit distant network programming under the Satellite Home Viewer's Act (SHVA).
The SHVA permits satellite carriers, such as NPS, a compulsory, statutory license to engage in secondary transmissions (or retransmissions) of copyrighted distant network programming to so-called "unserved households"-households that are unable to receive network programming at a specified level of intensity through the use of conventional rooftop antennas.
"We are extraordinarily pleased with the ruling," said Michael Mountford, chief executive officer of NPS. "We believe the Court's opinion vindicates our legitimate right to engage in the secondary transmission market."
NPS has 104 employees and retransmits distant networking programming to over 110,000 unserved households nationwide.
This case dates back to the 1990s when EchoStar began providing satellite television programming to subscribers under the DISH NETWORK brand. In 1998, various television networks including-CBS, ABC, Fox and NBC-and their network affiliates, sued EchoStar in Florida federal court claiming the company was improperly providing distant network programming to served-as opposed to unserved-households. Eventually, an injunction was entered in 2006 that prevented EchoStar from providing distant network programming under the SHVA's statutory license.
"There are public policy implications in today's ruling," explains Todd Vare, a partner in Barnes & Thornburg LLP's Intellectual Property Department, who argued on behalf of NPS. "If the court had ruled against NPS, the only distant network programming option for unserved households would have been DirecTV, thus creating a monopoly in this industry sector," added Vare.
NPS, an Indianapolis company that has been in the business of providing satellite services through C-band satellites since 1983, approached EchoStar in 2006 to inquire about leasing its satellite equipment. A deal was reached, which enabled NPS to use EchoStar's satellite transponder to retransmit distant network programming to unserved households who signed up with NPS.
The networks then accused NPS of violating the previously entered injunction against EchoStar. The Florida federal court sided with NPS, and the networks appealed. The Eleventh Circuit Court of Appeals also sided with NPS.
NPS is privately owned by Mike Mountford and Jon Pardieck. It does business under the trade name All American Direct.com. Dish Network launches Big Ten Network
Dish Network will launch the Big Ten Network today, September 6, on Channel 439. If you're a current Dish Network subscriber, and get the AT100 package or higher, you may tune in to Channel 439 for a free preview through early 2008.
HD subscribers can catch two games this Saturday, September 8, on Channel 9467. You'll need to be able to view HD, which requires subscription to a qualifying Dish Network programming package with DishHD, along with the necessary equipment, including an HD receiver and HD TV. Dish Network Launches Local TV Stations in High Definition in Denver Via Satellite
DishHD is Nation’s Largest Package of High Definition Channels
ENGLEWOOD, Colo., March 2, 2006 – EchoStar Communications Corporation (NASDAQ: DISH) and its DISH Network™ satellite TV service announced today it will launch local high definition TV channels via its satellite TV service to customers in Denver and its 61 surrounding counties. The following local TV channels will be available: ABC Ch. 7 (KMGH), CBS Ch. 4 (KCNC) and FOX Ch. 31 (KDVR).
This is the first time HD local channels are available by satellite TV in the Denver area, providing an alternative to local cable service. The NBC Ch. 9 (KUSA) affiliate is available in standard definition but is not yet available in high definition.

The two channels were restored to DISH Network customers at approximately 11 p.m. ET last night. Lifetime Television will return to the America’s Top 60 and DISH Latino Dos programming packages, while Lifetime Movie Network will be available in America’s Top 180 package.
Lifetime and Lifetime Movie Network’s entertaining and award-winning programming and advocacy include: Lifetime Original Movies like the February world premiere of For One Night starring Raven-Symoné; popular series like Will & Grace, The Golden Girls and Frasier, which joins the network in March; acclaimed dramas such as Strong Medicine and Missing; a full slate of upcoming original series including Cheerleader Nation, Face the Family, and LoveSpring (from Will & Grace’s Eric McCormack); and unparalleled support to women on issues of importance to them – including breast cancer, heart disease, violence against women, and economic equality.
This arrangement includes carriage under retransmission consent of the 28 Hearst-Argyle stations.

At $19.99 per month, DishFAMILY is not only the lowest priced “family programming” package available, it is also the lowest priced all digital TV package in America. Now with four primary programming tiers, DISH Network customers have even more choices.
According to PEW Research Center, 75 percent of 1,505 adults polled in 2005 favor tighter enforcement of government rules on TV content during hours when children are most likely to be watching television. The DishFAMILY package meets parents’ needs by ensuring that children are watching content that is appropriate while also offering channel choices for everyone in the family such as sports, news, children’s programming, lifestyle, hobbies, shopping and public interest. Dish Network Launches Oxygen Network
Oxygen, the Only Television Network Owned and Operated by Women, and DISH Network Satellite TV, Enter into Long-term Carriage Agreement
ENGLEWOOD, Colo., and New York, NY – Jan. 16, 2006 – EchoStar Communications Corporation (NASDAQ: DISH) announced today that Oxygen Media, the nation’s only woman owned and operated TV network, is now available to DISH Network satellite TV customers. Oxygen and DISH Network entered into a multi-year agreement and will provide 12 million DISH Network viewers with a free preview of Oxygen immediately.
Oxygen is a 24-hour television network on a mission to bring women (and the men who love them) the most innovative entertainment on television. From “Mo’Nique’s Fat Chance” which takes America’s average beauty competition and repackages it for America’s average size women to Oxygen’s newest hit “Campus Ladies,” Oxygen brings brave, original programming to women every day.

Oxygen airs a diverse array of original series including the spontaneous, unscripted “Oprah After the Show;” “Snapped,” a true crime series that explores the minds and motives of women who kill; “Girls Behaving Badly,” a hidden-camera prank show with the only all female cast, and Oxygen Original Movies. Oxygen also sponsors the “Mentor’s Walk,” a national movement to help bring along the next generation.

LAS VEGAS - Jan. 5, 2006 - EchoStar Communications Corporation (NASDAQ: DISH) and its DISH Network™ satellite TV service announced today from the 2006 International Consumer Electronics Show the rollout of its new high-definition television package, DishHD. By offering the most HD channels in the pay-TV industry and with the introduction of a new line of advanced satellite receivers, DishHD gives its customers more than 1,700 hours a week of HD content from the nation’s top programmers.
DISH Network is expanding its HD channel lineup in 2006 by adding five new original VOOM channels — bringing the total to 15 — as well as other new HD networks including ESPN2 HD and Universal HD. In addition, DISH Network will launch high definition local channels through its satellite service in up to 50 markets in 2006, starting with Boston, Chicago, Los Angeles and New York in February, and reaching more than 50 percent of U.S. TV households with local HD channels. The remainder of the country’s local HD channels will be offered to DISH Network customers via an off-air antenna solution.
DishHD offers 25 national HD channels plus local broadcast channels where available, providing more than 200 hours of HD programming every day. Cable companies, with a national average of just 10 HD channels, cannot come close to the robust lineup of DishHD.
With up to four different programming packages to choose from, DishHD customers can find an option that best fits their viewing needs. For as little as $54.99 a month, customers can access the entire 25-channel DishHD lineup, and get more than 70 all-digital standard definition channels plus their local channels in standard and high definition.

combine MPEG4 and MPEG2 signal capability. Existing customers with MPEG2 equipment, such as the DISH Player DVR 942, will continue to receive all their current content and will need to upgrade to a ViP Series receiver to receive the new HD channels. The ViP211™ HD satellite receiver, the first model in the ViP series that supports both MPEG4 and MPEG2, is available through DISH Network for only $49.99 for new lease customers.
Also included in the ViP series is the ViP622™ DVR, the world’s first MPEG4 multi-room high definition and digital video recorder satellite TV receiver with the ability to view independent programs – one in high definition and one in standard definition programming – on two televisions at once. No other pay-TV company offers this innovative combination. It features a massive hard drive with a recording capacity of up to 25 hours of high-definition and up to 180 hours of standard-definition content.
