"Show Us Your American Spirit" Photo Contest
Photographer’s Consent, Waiver of Liability and Release
By submitting my photographs to this contest, I am in agreement with all contest rules according to those stated on http://www.allamericandish.com/funandgames/contest_rules.htm, as well as all terms and conditions stated in this waiver. I declare that at the time of submission I am a legal resident of the continental United States, excluding Rhode Island and, and am 18 years of age or older.
I understand I am not required to purchase any products or services from All American Dish or any of its affiliated companies, and doing so will not have any influence on or increase my chances of winning. Employees of National Programming Service, LLC (the Sponsor), its companies, affiliates, agencies, and their immediate families are ineligible to participate in this contest. The contest begins at 12:00 am EST July 1, 2008 and concludes 11:59 am EST July 31, 2008. One entry per household. The grand prize of a $100 Gift Certificate to be used at AllAmericanDirect.com will be awarded at the conclusion of the contest. The gift certificate can not be applied to prior purchases.This contest is void in Rhode Island. Void where prohibited by law.
I grant permission to National Programming Service, LLC and its affiliated companies (All American Dish and AllAmericanDirect.com) the rights to use, reproduce, redistribute, and otherwise publicly display, either in print, electronically or on the web, the photographs voluntarily submitted by me as participation in the contest as well as my name and likeness. For the purposes of this document, the above listed companies will be referred to collectively as the Sponsor. The Sponsor may use my photographs, name and likeness for any and all marketing purposes, including but not limited to, advertising and promoting All American Dish or its companies.
I warrant the submitted photographs are originals taken by me, have not been tampered with, and are complete originals in all other aspects. No part of them is taken from or based off of any other work, nor do they infringe upon someone else’s rights or any copyrighted material;also, the reproduction, redistribution, or any other use of the photographs by the Sponsor in any form will not infringe upon any copyright or personal rights either directly or indirectly.
All prizes are non-transferable, and may not be substituted except at the discretion of the Sponsor. Cash will not be awarded in place of prize winnings. I understand, other than the prize winnings, I am not entitled to any other compensation, reward, or credit as a result of winning the contest or use of the photographs by the Sponsor. Winners are responsible for any federal, state, or local taxes on the prize. Winners will be selected by the judges from those entrants who fulfill each requirement of pet photo contest listed on http://www.allamericandish.com/funandgames/contest_rules.htm and will be based upon relevancy to the topic and uniqueness. Monthly winners will be notified on or around the first week of the following month in which their photo is submitted. Grand Prize winner will be notified on or around the first week of August. If after several attempts, we are unable to contact the winner, another winner will be selected in their place. Prize winnings will be shipped to the winner’s mailing address at the expense of the Sponsor. The retail value of the prize is $100.00 for the Grand Prize. I AGREE TO RELEASE National Programming Service, LLC, its affiliated companies, Executives, employees, their families, affiliates, or any other representative from any and all liability, claims, demands, actions, lawsuits, proceedings, or any other expenses which could occur now or in the future relating to any and all matters connecting to my participation in this contest. This may include, but is not limited to 1) copyright or proprietary right violation or infringement; 2) any property damage, act of unlawfulness, loss, injury or death that may occur as a result of or in connection with my preparation to participate in this contest 3) or relating to my use, misuse, or unwillingness to use the prize awarded. Furthermore, the Sponsor is not responsible for damaged, lost, or misdirected entries sent through the U.S. mail, nor for damages caused by visiting the web site or submitting entries through email.
By entering this contest, I understand and agree I may receive promotional or advertising materials from the Sponsor from time to time.
I have fully read and clearly understood the terms and requirements contained in this Agreement. I also understand these terms are contractual and by submitting my entry I am agreeing to this legally binding document.
